Personal Injury Protection – You Have Coverage

Last updated on July 3, 2023

Even though Florida is a no-fault state for automobile accidents, victims and their families can still recover damages for injuries or wrongful death. In Florida, all motor vehicle owners are required by law to carry personal injury protection (PIP) insurance.

Regardless of who caused the motor vehicle accident, PIP covers a driver as well as his or her passengers for any serious or fatal injuries, minus the driver’s deductible. The exact coverage for injuries is as follows:

  • 80 percent of medical expenses (provided they are necessary and reasonable)
  • 60 percent of wages lost because of time away from work after the crash

This coverage is usually limited to $10,000, although additional limits are available in some policies (as well as medical payment coverage). If a person dies, the policy covers up to $5,000 in death benefits.

If PIP Doesn’t Cover It, You Have Options

You might be thinking, “$10,000 isn’t enough to cover all of the medical expenses I have!” You’re right. Medical bills can reach into the hundreds of thousands of dollars in some cases, especially when there are catastrophic injuries, leaving victims feeling overwhelmed and frustrated.

If PIP insurance does not cover all of your medical expenses or you suffered a significant or permanent injury, you may be able to file a personal injury lawsuit to recover what the policy does not. Filing a lawsuit isn’t easy so consider retaining a lawyer when the time comes.
